Gemora Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Gemora applications, websites, APIs, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account or use the Service.

If you are under the legal age of majority where you live, your use of the Service may require the permission of a parent or legal guardian as required by applicable law.

The Service is not directed to children under 13.

2. The Service

Gemora provides AI-assisted features for conversation, journaling, reflection, organization, writing, planning, and personalized contextual experiences.

Features may change, be added, removed, limited, or updated over time.

3. AI-Generated Content

Gemora uses artificial intelligence systems to generate responses and other output.

AI-generated content may be inaccurate, incomplete, outdated, or misleading. You are responsible for evaluating AI-generated content before relying on it or taking action based on it.

Gemora does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

4. Not Professional or Emergency Advice

Gemora is not a healthcare provider, medical service, psychological counseling service, emergency service, or professional legal or financial advisor.

Features related to journaling, emotional reflection, or personal organization are intended for general informational and self-reflection purposes and do not constitute diagnosis, treatment, psychotherapy, crisis counseling, or professional advice.

If you are experiencing an emergency or immediate risk of harm, contact the appropriate local emergency service or qualified professional.

5. Accounts and Security

You are responsible for:

  • providing accurate account information;
  • maintaining the security of your login credentials;
  • activity performed through your Account;
  • notifying Gemora at support@gemora.app if you believe your Account has been accessed without authorization.

You may not use another person's Account without permission.

6. User Content

You retain ownership of User Content that you submit to the Service.

You grant Gemora a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, format, and otherwise use User Content only as reasonably necessary to:

  • provide and operate the Service;
  • generate AI-assisted responses and personalization;
  • maintain security and prevent abuse;
  • comply with applicable law.

Gemora does not sell your private User Content and does not use private User Content to train generalized public AI foundation models.

Your use of the Service must not violate the rights of others.

7. Memory and Personalization

Gemora may provide Memory or similar personalization features that retain preferences, recurring context, summaries, or other information associated with your Account.

Where available, you may manage stored Memory information through the Service.

Do not store passwords, authentication codes, full payment card numbers, government-issued identification numbers, or similar security credentials in Memory.

8. Acceptable Use

You may not use the Service to:

  • violate applicable law;
  • threaten, harass, stalk, exploit, or unlawfully harm another person;
  • facilitate fraud, deception, or unauthorized access;
  • infringe intellectual property, privacy, or other legal rights;
  • circumvent technical restrictions, security controls, or usage limits;
  • reverse engineer or attempt to extract source code except where applicable law expressly permits it;
  • create or distribute content that is unlawful or otherwise prohibited under applicable platform policies.

Gemora may investigate suspected violations and may restrict, suspend, or terminate access where reasonably necessary to protect the Service, users, or comply with law.

9. Subscriptions and Billing

Gemora may offer free and paid plans.

The applicable price, billing period, trial terms, renewal terms, and included features will be displayed before purchase.

Subscriptions purchased through Google Play, the Apple App Store, or another authorized payment provider are governed by the billing and cancellation terms presented at checkout and by the applicable provider's rules.

Unless otherwise stated at checkout, recurring subscriptions renew automatically until canceled.

Where a free trial is offered, the duration of the trial and the price that applies afterward will be disclosed before you subscribe.

Refund eligibility is subject to applicable law and the refund rules of the payment provider through which the purchase was made.

10. Account Deletion and Termination

You may stop using the Service at any time.

You may request deletion of your Account through:

  • In-App: Settings → Data Management → Delete Account;
  • Web: https://gemora.app/delete-account;
  • Support: support@gemora.app.

Account deletion is handled in accordance with our Privacy Policy and applicable retention requirements.

Gemora may suspend or terminate access if you materially violate these Terms, engage in abusive or fraudulent conduct, create security or legal risk, or where suspension or termination is required by law.

11. Third-Party Services

The Service may rely on third-party services, including AI providers, cloud infrastructure, authentication providers, payment services, and app stores.

Gemora is not responsible for third-party services that are outside Gemora's control. Your use of those services may also be subject to their own terms and privacy policies.

12. Intellectual Property

Except for User Content and third-party materials, the Service and its software, branding, interfaces, designs, and related intellectual property are owned by Gemora or its licensors and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of the Service or Gemora intellectual property.

13. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

Gemora does not warrant that the Service will be uninterrupted, error-free, completely secure, or suitable for every purpose.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Gemora will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Gemora's aggregate liability for claims relating to the Service will be limited to the amount permitted by applicable law.

Nothing in these Terms limits any rights or liabilities that cannot legally be limited or excluded.

15. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles.

Where applicable consumer law gives you mandatory rights or permits claims in another jurisdiction, those rights are not excluded by this section.

Subject to applicable mandatory law, disputes arising from these Terms or the Service will be handled by the competent courts of Vietnam.

16. Changes to These Terms

We may update these Terms from time to time.

If a change is material, we may provide notice through the Service, by email, or by another method required by applicable law.

The date at the top of these Terms indicates when they were last updated.
